Mission Statement The goal of the Berkeley County Planning and Zoning Department is to provide professional and technical advice to elected officials, appointed boards & commissions and citizens to assist in understanding the County's planning and zoning ordinances, standards and policies.

Rezoning Requests

Application forms for rezoning requests can be obtained from the Planning and Zoning Department, or downloaded from this site. There is a $250.00 non-refundable fee required for all requests. Each request is presented to the Planning Commission for recommendation to County Council. The Planning Commission meets the fourth Tuesday of the month. Submission date deadline is the fourth Tuesday of the month by 5 pm for the next month’s meeting. The process of rezoning takes a minimum of 90 days. All requests are advertised via the County website and posted with a yellow Berkeley County Planning Department hearing sign.

Variance, Special Exception Permit, and Appeals

Forms can be obtained through the Planning and Zoning Department and requires a $100.00 non-refundable fee for all requests. All properties are advertised in the newspaper and posted on site. Requests go before the Board of Zoning Appeals. Submission date deadline is the third Tuesday of the month by 5 pm for the following month’s meeting. The Board of Zoning Appeals meets the third Tuesday of every month.

Zoning Verification/Confirmation Letters

Please be advised that as of July 24, 2007, the Berkeley County Planning & Zoning Department requires a $5.00 fee per lot/Tax Map Number requested in a Zoning Verification Letter. The Planning Department requires all requests in writing.

Please be advised that any additional information requested may require a FOIA Request per the Freedom of Information Act, Section 30-4-10, et seq., Code of Laws of South Carolina (1976, as amended.)

Berkeley/Dorchester County Boundary Dispute Resolution

Berkeley and Dorchester Counties were engaged in a boundary dispute that was resolved on November 7, 2018. As a result, Berkeley County’s boundary has been clarified to include approximately 3,200 acres of land that was formerly in Dorchester County (referred to as the “Transition Area”). To respond to this change and to ensure that every parcel contested in the “Transition Area” is zoned to an unincorporated Berkeley County Zoning District in an efficient timeframe, County Council directed the Planning and Zoning Department to coordinate with the Berkeley County Planning Commission to develop zoning district recommendations for its consideration. To develop its recommendations, the Department conducted windshield surveys to assess the existing land use of affected and adjacent properties, considered former Dorchester County zoning designations, and referred to the Berkeley County Future Land Use Map Recommendations.

Public Process:
Before County Council entertained the zoning districts proposed for the Transition Area, a recommendation by the Berkeley County Planning Commission was first required. In order for the zoning district recommendations to go into effect, they will need to be approved and adopted by three (3) readings of County Council. Planning Commission reviewed the proposed zoning districts and made their initial recommendations at the April 23, 2019 meeting. County Council then referred back to the Planning Commission the proposed zoning districts with revisions to the text of the accompanying “Zoning Map Amendment Ordinances”, which the Planning Commission recommended to approve with minor textual revisions at the June 25, 2019 meeting. Planning Commission’s recommended modifications were then considered by County Council at Land Use Committee on July 8, 2019 and at Second Reading on July 22, 2019

Upcoming Land Use Committee and County Council Meeting Dates:
Berkeley County Council will next consider the zoning districts proposed for the Transition Area atconsideration prior to third reading at Land Use Committee, scheduled for 6:00 PM on August 12, 2019; the public hearing as well as the third (3rd) and final reading are tentatively scheduled for August 26, 2019 at 6:00 PM. All meetings are held in the in the Berkeley County Assembly Room, located at 1003 Highway 52 in Moncks Corner, SC 29461. The upcoming meeting schedule is provided below.

Subsequent Rezoning of Affected Parcels:
After adoption of the proposed Zoning Districts by County Council, a property owner or his/her authorized agent, may at his/her discretion, request a change in the zoning that was established for the affected property by submitting an “Application for Rezoning” and any necessary supporting documentation to the Berkeley County Planning and Zoning Department as pursuant to the typical processes and deadlines as established in Article 22 of the Berkeley County Zoning Ordinance. If an “Application for Rezoning” is submitted within six (6) months from the date that the Zoning Districts proposed for the Transition Area are approved and adopted by County Council, the Department will waive the application fee.
